CITY OF BELLEVUE  

JOB DESCRIPTION

Full-Time Salary Range $ 83,820 - $123,864

POSITION TITLE: Assistant City Attorney 

REPORTS TO: City Attorney

SUPERVISES: N/A 

PURPOSE OF POSITION:

Responsible for assisting the City Attorney in providing professional legal services to the Mayor, City Council, City Administrator, City Departments and various boards and commissions. Receives general direction from the City Attorney.

ESSENTIAL FUNCTIONS:

Assists the City Attorney with legal activities of the city in providing policy, technical and administrative support to the Mayor, City Council and City Administrator.

Prepares legal opinions relating to city matters; conducts research on specific points of law.

Assists the City Attorney with all aspects of case and file management.

Advises city staff on legal problems and questions; assists departments in the administration of personnel matters; assists in providing and coordinating management staff training on legal topics.

Drafts ordinances, resolutions, contracts, deeds, leases, agreements and other legal documents; assists in formulating proposed legislation for enactment by the State legislature in regard to matters of interest to the city.

Assists with all aspects of case preparation and drafting items such as pleadings, discovery and other correspondence as directed by the City Attorney.

Monitors and interprets legislation impacting or affecting the city or its operations and activities.

ESSENTIAL FUNCTIONS (CONTINUED):

Assists in preparing civil and criminal cases for trial; investigates claims and complaints by or against the city; assists in prosecuting criminal ordinance violations in county court, and trying cases before county, state and federal courts.

Upon request of the City Attorney or City Administrator, attends various meetings including the City Council, Planning Commission and Board of Adjustment meetings and serves as a member of various committees and boards to answer inquires and make recommendations pertaining to legal aspects for the city.

Assists in negotiation and preparation of labor agreements.

Assists in establishing and maintaining a complex file system by accurately filing legal records, documents and reference material.

Attends various seminars and conferences to maintain awareness and keep abreast of changes in legal and legislative responsibilities.

Assists in performing administrative duties including the preparation and presentation of various legal reports and records.

Operates standard office equipment including but not limited to computer, email, copier, fax machine, telephone, etc. 

Establishes and maintains positive public relations with the general public, other employees, other governmental agencies and municipal officials.

Participates in the development and implementation of goals, objectives, policies and priorities for the Legal Department; identifies resource needs; recommends and implements policies and procedures.

ESSENTIAL KNOWLEDGE, EXPERIENCE AND ABILITY:

Knowledge of and ability to apply and interpret city, state and federal laws, codes, ordinances, statutes and court decisions relating to civil matters and public labor law.

ESSENTIAL KNOWLEDGE, EXPERIENCE AND ABILITY (CONTINUED):

Knowledge of and ability to apply the principles and practices of real property and land use law, including ownership, acquisition and conveyance.

Knowledge of tort law and liability insurance litigation.

Knowledge of judicial procedures and rules of evidence.

Knowledge of and ability to apply appropriate methods of legal research.

Knowledge of city responsibilities and ability to use independent judgment in the performance of duties.

Knowledge of and ability to operate standard office equipment; ability to perform input and retrieval functions utilizing a variety of computer programs dealing with word processing, spreadsheet and databases.

Ability to analyze problems, identify alternative solutions, project consequences or proposed actions and implement recommendations in support of goals.

Ability to analyze, appraise, organize and present facts, evidence and precedents in a clear and logical form.

Ability to conduct research on legal problems and prepare sound legal opinions using independent judgment.

Ability to train management staff on a variety of legal topics and activities.

Ability to accurately prepare, maintain and analyze various legal documents, records, reports and correspondence.

Ability to deal with the general public in a courteous and tactful manner.

Ability to plan and organize a personal work schedule, set priorities and meet deadlines.

Ability to maintain regular and dependable attendance on the job, including attendance and job performance for possibly prolonged periods of time when called out on short notice due to emergencies and similar situations of public necessity.

Ability to understand, follow both oral and written instructions, and communicate effectively, verbally and in writing, in English.

ESSENTIAL KNOWLEDGE, EXPERIENCE AND ABILITY (CONTINUED):

Ability to establish and maintain effective working relationships with the public, other employees, other governmental agencies and municipal officials.

CONFIDENTIAL INFORMATION:

This position has a high degree of access to confidential information and shall be bound by the same confidentiality requirements as the City Attorney. All matters shall be confidential and not disclosed to third-parties other than the City Attorney and other authorized City officials including, but not limited to, the Mayor and City Administrator.

ESSENTIAL EDUCATION, CERTIFICATION AND/OR LICENSES:

  1. Must possess a valid driver’s license at the time of hire.
  2. Graduation from an accredited law school with a Juris Doctorate degree.
  3. Must have a license to practice law in the State of Nebraska.
  4. Must be bondable.

ESSENTIAL PHYSICAL DEMANDS AND TYPICAL WORKING CONDITIONS:

Work is generally performed indoors in an office setting and requires routine bending, lifting and carrying office supplies, books, files and other materials. The incumbent is required to frequently sit for extended periods of time, talk, hear and must have the ability to transport themselves to and from various locations within City Hall and throughout the city and its extra-territorial jurisdiction. Hand-eye coordination is necessary to operate computers and various other pieces of equipment. While performing the duties, the incumbent is required to use hands to finger, handle, feel or operate objects, tools or controls and to reach with hands and arms. 

Work hours may occasionally be required in times of darkness. Vision abilities required for this position include close vision and the ability to adjust focus. The noise level is usually quiet or moderate.

Work requires extensive interaction with the general public and may be stressful when dealing with citizens and/or meeting deadlines.
